Europe - PPE

 

The deadline for transitional provisions of PPE Regulation (EU) 2016/425 is near

 

20th April 2019 is the deadline for transitional provisions in Personal Protective Equipment (PPE) Regulation (EU) 2016/425. This deadline is indicated in Article 47 if this Regulation.

 

During the transitional period, Member States shall not impede the making available on the market of products covered by Directive 89/686/EEC which are in conformity with that Directive and which were placed on the market before 21 April 2019. But from 21st April 2019, all PPE shall comply with the requirements of PPE Regulation.

 

PPE with EC type-examination certificates and approval decisions issued under PPE Directive 89/686/EEC (issued before 21 April 2019) shall remain valid until 21st April 2023 (unless they expire before that date).

France - PPE

 

Availability of personal protective equipment on the market

 

On 1st February 2019,  the French Authorities published Decree No. 2019-62 of 30 January 2019 relating to personal protective equipment.

 

The Decree provides for the implementation of the provisions of Regulation (EU) No 2016/425 of the European Parliament and of the Council of 9 March 2016 on personal protective equipment and repealing Council Directive 89/686 / EEC. These measures concern the sanctions system, inserted in the Consumer Code, in the event of a breach of the obligations provided for in the Regulation. This is to secure the provision of personal protective equipment on the market.

 

The text enters into force the day after its publication.

Europe - Lifts

 

Report on the implementation and functioning of Directive 2014/33/EU

 

On 22nd February 2019, the European Commission published a report on the implementation and functioning of Directive 2014/33/EU of the European Parliament and of the Council of 26 February 2014 on the harmonisation of the laws of the Member States relating to lifts and safety components for lifts.

 

The outcome of the evaluation is positive. The Directive is working well and it is deemed to be an efficient means to establish a Union wide harmonised framework.

 

Consequently, as response to the findings of the evaluation, the Commission will take the following main measure, within others:

 

  • Clarify the terminology and definitions of the Directive
  • Improve the coordination among Member States of "prior approval" procedure (point 2.2, last paragraph, of Annex I)
  • The Commission will clarify the lifts accessibility requirements for disabled persons
