UFI: the New Element in the Label of Chemical Products

From 2020, a new element in the label of the chemical products will be found. It will be the UFI (Unique Formula Identifier) code (a code of 16 characters)

By 2025 it will be mandatory that all the products classified for health and physical hazards include this UFI code in its label. Importers and downstream users placing such products on the market will have to provide this UFI code together with the specific product information to poison centres.

Draft Guidance Proposal on Annex VIII to CLP (Notification to Poison Centres)

 

On 2nd March, the European Chemicals Agency (ECHA) published the draft guidance on the interpretation and application of  Annex VIII to CLP Regulation (EC) No 1272/2008. This annex is related to information used by poison centres and the final guidance is expected to be published by December 2018.

CLP: 9th Adaptation to Technical Progress (ATP).

The ninth adaptation to technical progress (ATP09) of the harmonized classification (CLH) is in force from 1 march 2018

1 June 2017 was the end of the transitional period between the old and the new legislation. By that time all DPD-labelled products should have been removed from the supply chain.

It is for this reason that the 9th Edition removes Table 3.2 from Annex VI to CLP Regulation (EC) No 1272/2008  that contained the harmonised substance classifications according to the old Dangerous Substances Directive (DSD).

As a reminder, the 10th Edition (ATP10) is already available and will be in force from 1 December 2018.

  • mancozeb (ISO); manganese ethylenebis(dithiocarbamate) (polymeric) complex with zinc salt (EC -; CAS 8018-01-7). It is an active substance (fungicide) used in plant protection products.

The deadline for comments is 27 April 2018

  • Octhilinone (ISO); 2-octyl-2H-isothiazol-3-one; [OIT] (EC 247-761-7; CAS 26530-20-1). It is an active substance mainly used in biocidal products (fungicide)
  • 3-(difluoromethyl)-1-methyl-N-(3',4',5'-trifluorobiphenyl-2-yl)pyrazole-4-carboxamide; fluxapyroxad (EC -; CAS 907204-31-3). It is an active substance (fungicide) used in plant protection products.
  • Oxathiapiprolin (ISO); 1-(4-{4-[5-(2,6-difluorophenyl)-4,5-dihydro-1,2-oxazol-3-yl]-1,3-thiazol-2-yl}piperidin-1-yl)-2-[5-methyl-3-(trifluoromethyl)-1H-pyrazol-1-yl]ethanone (EC -; CAS 1003318-67-9). It is an active substance used as a fungicide in plant protection products.
  • m-bis(2,3-epoxypropoxy)benzene (EC 202-987-5; CAS 101-90-6). It is an industrial chemical used in the production of resins and rubbers

  • Calcium Cyanamide (CAS Nº: 156-62-7). Call about the use as a fertiliser.

Eight proposals to identify new substances of very high concern (SVHCs): 

  • octamethylcyclotetrasiloxane (D4) (EC 209-136-7) - used in washing and cleaning products, cosmetics and personal care products and polishes and waxes;
  • decamethylcyclopentasiloxane (D5) (EC 208-764-9) - used in cosmetics and personal care products, polishes and waxes, washing and cleaning products and textile treatment products and dyes.
  • dodecamethylcyclohexasiloxane (D6) (EC 208-762-8) - used in polishes and waxes, washing and cleaning products, and cosmetics and personal care products;
  • ethylenediamine (EC 203-468-6) - used in adhesives and sealants, coating products, fillers, putties, plasters, modelling clay, and pH regulators and water treatment products;
  • terphenyl hydrogenated (EC 262-967-7) - used as plastic additive, as solvent, in coatings/inks, in adhesives and sealants;
  • lead (EC 231-100-4) - used in metals, welding and soldering products, metal surface treatment products, polymers and heat transfer fluids;
  • disodium octaborate (EC 234-541-0) - used in antifreeze products, heat transfer fluids, lubricants and greases and washing and cleaning products;
  • benzo[ghi]perylene (EC 205-883-8) - not registered under REACH; normally not produced intentionally, but rather occurs as a constituent or impurity in other substances.

Dodecamethylcyclohexasiloxane (D6) has been added in registry of restriction intention list on request of the European Commission to the intention that was originally submitted on 13 April 2017 for octamethylcyclotetrasiloxane (D4) and decamethylcyclopentasiloxane (D5) for personal care products and other consumer/ professional products in concentrations >0.1 % for submission on 13 January 2019

China Issues "The Standard Management Catalogue of Limiting the Use of Hazardous Substances in EEE"

 

On March 12th 2018, the Ministry of Industry and Information Technology (MIIT) issued  "The Standard Management Catalogue of Limiting the Use of Hazardous Substances in Electrical and Electronic Equipment (EEE) (first batch)" and "The Exemption List to the Use of Restricted Substances in the Standard Management Catalogue”. These two standards shall come into force one year after the date of announcement.

 

The Management Catalogue describes the definition of scope and application for twelve products: Refrigerators, Televisions, washing machines, air conditioners, water heaters, printers, photocopiers, fax machines, monitors, microcomputers, mobile handsets and telephone handsets.  

 

The content of Lead, mercury, cadmium, hexavalent chromium, polybrominated biphenyls and polybrominated diphenyl ethers in those products shall be in accordance with the limit standards of the use of hazardous substances in EEE which is similar as European RoHS Directive. Meanwhile, the product should be included in the Conformity Assessment System of Limiting of the Use of Hazardous Substances in EEE.

 

The products listed in "The Exemption List to the Use of Restricted Substances in the Standard Management Catalogue" should fulfill obligations in accordance with the special restrictions indicated in the exemption list without dates of applicability.

California Proposition 65 Reformulations (March, 2018)

 

California Proposition 65 is the ‘Safe Drinking Water and Toxic Enforcement Act of 1986’, which has been effective for almost 30 years. Due to the implement of California Proposition 65, more and more court cases are settled to reduce the exposure to carcinogenic and toxic for reproduction chemicals by reformulating consumer products containing such chemicals.

Mexico

Draft Proposal for Labelling and Packaging of Hygiene Products for Household Use

 

On 13 March 2018, Mexico notified the World Trade Organization (WTO) about Draft Mexican Official Standard “PROY-NOM-189-SSA1/SCFI-2016 Products and services. Labelling and packaging for hygiene products for household use”

The aim of this draft proposal is to define labelling and packaging requirements for hygiene products for household use in order for customers to be informed about the use and hazards of this type of products.
