Evaluation of the Legislative Framework of Food Contact Materials (FCM)

In May 2016, the European Parliament published “European Implementation Assessment report on Regulation (EC) No 1935/2004”. This report showed that the lack of specific measures at EU level for some food contact materials negatively impacts the functioning of the internal market. |
Based on this, the European Commission launched an initiative and roadmap with the aim to assess whether the current EU legislative framework for FCM is fit for purpose and works as intended, as well as assessing the situation regarding materials for which there are no specific EU measures and which are subject to national authorization measures will also be assessed.
The feedback period regarding this initiative was closed on 26th December 2017.

Summary about Latest Meeting of EU Working Group on FCMs
On 27 November 2017, the EU Technical expert group on FCM meeting was held. Topics discussed in this meeting:
- The revision of the ceramics Directive 84/500/EEC with EU Member States (MS) and stakeholder organizations from the ceramics, glass, and enamel industries, as well as the European Consumer Organisation (BEUC). The following presentations and summary have been published by DG SANTE:
- The content of Regulation (EU) No 284/2011 addressing the import of polyamide and melamine plastic kitchenware originating in or consigned from the People’s Republic of China including Hong Kong.
- EC announced the publication of the roadmap on the evaluation of FCM Regulation (EC) 1935/2004.
Germany
Third Amendment to the Basis for Assessment of Metallic Materials in Contact with Drinking Water.

On 15th December 2017, Germany notified the European Commission a draft about the “Third amendment to the basis for assessment of metallic materials coming into contact with drinking water (Metal assessment basis)”
Since the first amendment was notified by Germany in 2015, it was necessary to urther amend the basis for assessment of metallic materials since additional materials have been classified as being suitable for use in contact with drinking water and, hence, these should be added to the positive list accordingly

NHFPC Published New Notice Regarding 3 New Approved Food Contact Additives and Other Relevant Updates
On November 27, 2017, National Health and Family Planning Commission of the People’s Republic of China (NHFPC) adopted the safety evaluation of some new additives and monomer from China National Centre for Food Safety Risk Assessment (CFSA), and published Notice No.11 of 2017 based on food safety law. This updated rule will come into effect on the date of publication.
