CPSC Updates Exemption on Certain Plastics for Final Phthalates Rules
On Jan 26, 2018, CPSC published a Direct Final Rule in Federal Register revising Rule 16 CFR 1308. This direct final rule amends 16 CFR 1308 to cover the phthalates listed 16 CFR Part 1307.
As amended, the following plastics with specific additives (as described in 16 CFR 1308.1) are not required to be third-party tested for demonstrating phthalates prohibition compliance (16 CFR 1307):
- Polypropylene (PP)
- Polyethylene (PE)
- Acrylonitrile butadiene styrene (ABS)
- High-impact polystyrene (HIPS)
- General purpose polystyrene (GPPS)
- Medium-impact polystyrene (MIPS)
- Super high-impact polystyrene (SHIPS)
This rule is effective on April 25, 2018 (same day as 16 CFR 1307) unless the Commission receives significant adverse comment by February 26, 2018.
