Limit Dates for Methylisothiazolinone and Zinc Oxide
As a reminder, the limit dates are approaching for the ingredients Methylisothiazolinone (MIT) and Zinc Oxide for cosmetic products regarding compliance with the amending Annexes to Regulation (EC) No 1223/2009 of the European Parliament and of the council on cosmetic products:
- Regulation (EU) 2017/1224 amending Annex V to Regulation (EC) No 1223/2009, Entry 57:
- 2-Methyl-2H-isothiazol-3-one (CAS 2682-20-4) (MIT): Rinse-off cosmetic products containing MIT at a concentration greater than 15 ppm must be removed from the market before 27 April 2018
- Regulation (EU) 2017/1413 amending Annex IV to Regulation (EC) No 1223/2009, Entry 144:
- Zinc Oxide (For use as a UV-filter, see Annex VI, No 30 and No 30a) (CAS 1314-13-2): Not to be used in applications that may lead to exposure of the end-user's lungs by inhalation. Products not complying with this Regulation shall be removed from the market before 24 May 2018

Spain
Approval of Cosmetics Royal Decree
On 23 February 2018, the Spanish Council of Ministers has approved a new Royal Decree for the regulation of cosmetic products for the benefit of consumer safety and that adapts Spanish legislation to European regulations (“Real Decreto 85/2018, de 23 de febrero, por el que se regulan los productos cosméticos”)
The main points of this Royal Decree are detailed as follows:
- Regulation of the competent authorities in the matter of cosmetic products:
- AEMPS (Spanish Agency for Medicines and Health Products)
- CCAA (Local Pharmaceutical Inspection Authorities)
- AASS (Local Health Authorities)
- INTCF (Spanish Poison Centre)
- The communication of the Spanish Cosmetovigilance System through AEMPS.
- The language to be used in the labeling as well as in the information file of the products shall be Spanish, but specialized scientific documentation in French or English may be accepted. In case of doubts, Spanish translation may be required.
- The rules for labeling the products (nominal content, expiration date, precautions and function of the product).
- The procedures for market control activities to be carried out by the competent authorities, the powers of inspection, adoption of health protection measures, the national alert network of cosmetic products (AECOSAN) and European Rapid Alert System (RAPEX).
- The procedure of Responsible Declaration of manufacturing and import activities, the requirements of facilities (own and subcontracted), technical manager and quality management system to be implemented by companies engaged in the manufacture and import of cosmetics in the Spanish territory.
- The criteria to be applied by inspections in the border health control of imported cosmetic products.

China
China Publishes 35 New National Standards on Cosmetic Products On 6 February 2018, the General Administration of Quality Supervision, Inspection and Quarantine of the People’s Republic of China (AQSIQ) and the Standardization Administration of the People’s Republic of China launched 35 new national standards on cosmetic products. They will be effective from 1 September 2019. |
