Publication of Regulation (EU) 2018/1847 amending Annex V of Cosmetic Regulation

 

On 27th November 2018, the European Commission published “COMMISSION REGULATION (EU) 2018/1847 of 26 November 2018 amending Annex V to Regulation (EC) No 1223/2009 of the European Parliament and of the Council on cosmetic products” with reference C/2018/7724.

 

The main points in this amendment are:

 

  • Entry 7 in Annex V to Regulation (EC) No 1223/2009 is replaced by the following:

Cosmetic products containing Biphenyl-2-ol and not complying with these conditions shall not be placed on the Union market from 17 June 2019 and from 17 September 2019 they shall not be made available on the Union market.

 

  • From 17 June 2019 cosmetic products containing Sodium 2-biphenylate, Potassium 2-biphenylate or 2-aminoethan-1-ol; 2-phenylphenol as preservatives shall not be placed on the Union market.
    From 17 September 2019 cosmetic products containing Sodium 2-biphenylate, Potassium 2-biphenylate or 2-aminoethan-1-ol; 2-phenylphenol as preservatives shall not be made available on the Union market.

Consultation on restricting substances in tattoo inks and permanent make-up under REACH

 

The European Chemicals Agency (ECHA), has recently launched a public consultation on the draft opinion of SEAC (Committee for Socio-Economic Analysis) regarding a REACH Annex XV dossier proposing restriction of certain chemicals in tattoo inks and permanent make-up.


The deadline for submitting comments is 11 February 2019.

Denmark

 

Temporary ban on microplastics in cosmetic products

 

On 5th December, the Environmental and Food Ministry of Denmark announced its intention to introduce a temporary ban on microplastics in rinse-off cosmetic products until an EU ban is in place.

This temporary ban on microplastics in rinse-off cosmetic products will apply from 1 January 2020, at the latest. From that date it will no longer be permitted to use solid plastic particles of less than five millimeters in rinse-off cosmetic products. In addition, an analysis will be made in order to consider the expansion of the scope of this national ban to cover other cosmetic products within three years.

The following 7 alerts regarding cosmetic products have been reported, from week 47 until week 50 of 2018.

Antiseptic soap: The product contains too much triclocarban as a preservative (measured value: 1.3% in weight) and 4-chloroaniline (measured value: 0.2% in weight). Aromatic amines can cause cancer and/or allergic reactions.

Hair care product and Body Lotion: The products contain a mixture of the preservatives Methylchloroisothiazolinone and Methylisothiazolinone (MCI/MI).

Dermal contact with MCI and MI containing products can provoke allergic contact dermatitis to sensitised persons.

Perfumes  containing certain substances which can induce allergenic reactions and sensitisation and that are not indicated in the list of ingredients (consumers are not aware of their presence).

Choking

Bath product:  Due to its characteristic appearance, colour and size, the product may be mistaken for foodstuff. The product has pieces that can be easily detached. A child may put these pieces in the mouth (choking hazard).

The product does not comply with the Cosmetics Regulation or with the requirements of the Food imitating Products Directive.
